This Privacy Policy ("Policy") describes how Apex LLC ("Apex," "we," "us," or "our") collects, uses, stores, shares, and protects information when you use the Apex platform and all related services (collectively, the "Service"). By using the Service, you agree to the practices described in this Policy.

This Policy applies to: (1) business customers who subscribe to the Apex platform ("Subscribers"); and (2) information about third parties (such as homeowners) that Subscribers access or input through the Service.

Through the Lead Scraper feature, Subscribers may access homeowner data aggregated from publicly available property records and third-party data providers. This data may include property owner names, mailing addresses, estimated home values, and phone numbers. Apex acts as a data processor with respect to this information on behalf of our Subscribers.

3. How We Share Your Information

We do not sell your personal information to third parties. We share information only in the limited circumstances below.

3.1 Service Providers

All service providers are contractually required to use your data only to provide services to Apex and are prohibited from using it for their own purposes.

3.2 Business Transfers

If Apex is involved in a merger, acquisition, or asset sale, your information may be transferred. We will notify you via email before your information is transferred and becomes subject to a different privacy policy.

3.3 Legal Requirements

We may disclose your information if required by law, court order, or to protect the rights, property, or safety of Apex, our users, or the public.

We retain your account information and CRM data for as long as your account is active. If you cancel, we retain your data for 90 days to allow for reactivation. After 90 days, your data is permanently deleted, except where we are required to retain it for legal or compliance purposes.

Anonymized and aggregated data that cannot identify you may be retained indefinitely for platform improvement purposes.

You may update account information through your account settings. You may request deletion of your account and personal data by contacting us. We will complete deletion within 30 days of a verified request.

7.3 Opt-Out of Marketing

Click the unsubscribe link in any marketing email or contact us at [email protected]. You will still receive transactional account communications.

7.4 California Residents (CCPA)

California residents have the right to know what personal information we collect, the right to delete it, and the right to non-discrimination for exercising these rights. Contact us at [email protected] to exercise these rights. We will respond within 45 days.

7.5 Florida Residents (FDBR)

Florida residents have rights under the Florida Digital Bill of Rights (effective July 1, 2024), including rights of access, correction, deletion, and portability. Contact us at [email protected] to exercise these rights.

The Service may contain links to third-party websites or integrate with third-party services (such as Google Maps, Stripe, or social media platforms). This Privacy Policy does not apply to those third-party services. We encourage you to review their privacy policies independently.

The Apex platform is intended for use by businesses and business professionals. We do not knowingly collect personal information from individuals under the age of 18. If we become aware that we have inadvertently collected information from a minor, we will delete it promptly.

When you use the Lead Scraper or input contact information about third parties into the CRM, you are responsible for:

Apex acts as a data processor on your behalf with respect to third-party contact information you manage within the platform. You are the data controller and are responsible for the lawful basis for processing that data.

11. International Data Transfers

Apex is based in the United States. If you access the Service from outside the United States, your information may be transferred to, stored, and processed in the United States or other countries where our service providers operate. By using the Service, you consent to this transfer.

12. Changes to This Policy

When we make material changes, we will notify you by email and by posting a notice in the platform at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Policy.
